Higher Bowden Holiday Cottages Limited
Terms and Conditions of Cottage hire
"Short-Term Holiday Rental" shall mean the hire of the Property as holiday accommodation together with the non-exclusive use of the communal facilities available to guests staying at any of the properties on the Site.
"The Party Leader" shall mean the person booking the Short-Term Holiday Rental.
" The Company" shall mean Higher Bowden Holiday Cottages Ltd.
" The Holiday Rental Party " shall mean all the guests for whom the Party Leader is booking the Short-Term Holiday Rental, including the Party Leader.
"The Booking" shall mean the receipt by the Company of a completed booking form from the Party Leader requesting that the Company provide the Party Leader and/or the Holiday Rental Party with a Short-Term Holiday Rental.
" The Rental" shall mean the period of the Short-Term Holiday Rental.
" The Rental Fee" shall mean the price of the Short-Term Holiday Rental.
" The Due Date" shall mean the date six weeks before the commencement of the Rental.
" The Property" shall mean any cottage in which the Holiday Rental Party and/or the Party Leader will be staying during the Rental.
"The Site" shall mean the Higher Bowden Holiday Cottages Site near Dartmouth Devon on which The Property is situated.
The contract for a Short-Term Holiday Rental shall be made between The Party Leader and the Company, the contract will be entered into when the Company issues the confirmation letter, having received a deposit of not less than 30% of the Rental Fee and a completed booking form, and will be subject to all the following terms and conditions. References to "you" and " your" mean The Party Leader and all members of the Holiday Rental Party who have been accepted by The Company.
A deposit of 30% of The Rental Fee is payable if the Booking is made more than six weeks before the start of The Rental. The balance will be payable on or before the Due Date. Non-payment of the balance of The Rental Fee on or after The Due Date shall be construed as a cancellation of the contract by The Party Leader. For bookings made less than six weeks before the start of The Rental, the total fee is payable on sending the booking form. Cheques should be made payable to "Higher Bowden Holiday Cottages Ltd" and sent to the address at the top of the booking form. If you pay by credit card, The Company reserves the right to make a charge of up to 2% of The Rental Fee to recover the credit card company's charges.
The Company does not as a rule allow group or party bookings where more than one cottage is required by the renter(s). However in the circumstance that such a booking is allowed then the Company reserves the right to charge an additional refundable deposit of £50/cottage for parties who book more than one cottage or are intending to meet up with other families or friends staying in cottages at Higher Bowden.
You must take all necessary steps to safeguard your personal property. No liability is accepted by The Company in respect of damage to, or loss of such personal property except in the case where the damage or loss is solely caused by negligence of The Company or its employees, provided they were at the time acting in the course of their employment.
Any cancellation made by The Party Leader and/or on behalf of the Holiday Rental Party for any reason shall be in writing and addressed to Dr and Mrs Peter Horne at the address at the top of the booking form. On receipt of notice of cancellation, The Company will seek to re-let The Property for The Rental. If The Company succeeds in re-letting The Property for the whole period of The Rental, it shall refund all the monies paid less an administrative charge of £20 (plus VAT). If The Company only succeeds in re-letting The Property for part of The Rental, it shall refund an amount equal to the money paid less (i)The Rental Fee for that part of the Rental that the Property is not re-let and (ii) an administrative charge of £20 (plus VAT). If The Company is unable to re-let The Property before The Due Date, you remain liable for the balance of The Rental on The Due Date as indicated in the payment section above. If The Company is successful in re-letting The Property for the whole or part of The Rental after you have made the final payment, you will be reimbursed in accordance with the refund conditions above. We advise that you take out a separate holiday cancellation insurance. We can supply you on request of details of Premier Cottages Direct Guest Scheme- arranged by Michael Pavey, Westinsure.
Period of Hire
Rentals commence at 3:30pm on the day of arrival and terminate at 10 am on the date of departure. The maximum rental period is for 21 consecutive days, rentals of a longer duration or consecutive 21 day rental periods will not be accepted.
Vat is included in The Rental Fee. If Vat or IPT rates change, or any additional taxes or levies be introduced which may affect the price of your holiday, you may be required to pay the extra amount. Alternatively, should the rate of VAT or IPT or any Government imposed Tax or Levy included in the quote prices decrease so that a lower rate applies to your holiday, the price of your holiday will be reduced accordingly.
Number of person using The Property
The numbers of person occupying The Property must not exceed the maximum numbers stipulated in the Company's brochure or web-site and must be the same as stated on the booking form. The Company reserves the right to refuse entry to the entire party if this conditions is not observed. In addition, The Company must be notified if the Holiday Rental Party wishes to invite visitors onto The Site. The Company reserves the right to refuse entry and/or use by such persons of The Property, and the facilities on Site.
Should there be any cause for complaint during The Rental, it must be notified at once to The Company.
Use of The Property
You must use The Property for the purpose of a private holiday rental only and for no other purpose whatsoever. You must not do anything or in connection with the Property that may be or tend to be a nuisance, annoyance or cause of damage to The Company or any neighbouring or adjoining property occupiers, or allow anyone else to do so. You must not play any musical instrument or device and must not allow noise from a radio, television set, compact disc or any record player or sound production system or any kind of machine or equipment to be heard outside The Property after 11 pm or before 8 am. You should take all reasonable and proper care of The Property and associated facilities, furniture, pictures, fittings and effects in or on the Property and leave them in the same state of repair and condition and in the same clean and tidy state at the end of The Rental as at the beginning. You shall reimburse The Company on demand for any replacement or repair of any items in The Property that is broken or damaged during The Rental and for any extra cleaning costs incurred by reason of your failure to comply with the terms of this paragraph, alternatively or additionally the company reserves the right to refuse a future booking from the party leader or related party or not provide any returning guest discount. Smoking is not permitted in The Property or any other cottages on the Site.
The Company's Duty of Care
All properties situated on the Higher Bowden Holiday Cottages Site are maintained to a high standard. In the rare event of a breakdown of a particular service or item, a repair/replacement shall be found/fitted within twenty-four hours when possible and within three working days maximum. The Company cannot be held liable for any loss arising from loss of use of the service/item within the specified time limit. The Companies liability for any loss arising from a loss of use of any service/item for longer than the specified time limit is limited to the value of The Rental Fee.
Pets & Assistance Dogs
The Company regrets that no pets can be accepted at the Property or any of the properties situated at the Site. The Company reserves the right to refuse entry to any Holiday Rental Party who bring a pet on to The Site. Registered assistance dogs (guide dogs, hearing dogs etc.) are accepted but the Company must be informed at the time of booking. This is of critical importance in order that the Company can inform any asthma (dog allergies) sufferers who may be staying at the same time and accessing the common facilities or staying in the same cottage at a later date.
Right of entry
The Company and/or its agents reserve the right to enter the Property at any reasonable time for the purposes of inspection or to carry out any necessary repairs or maintenance, notice of such will be given when practicable.
The Company's right to refuse
The Company reserves the right to refuse any booking, and in exceptional circumstances, to cancel, modify or alter arrangements made for the Party Leader and/or the Holiday Rental Party. Should The Company cancel the Rental through no fault of yours or any member of The Holiday Rental Party the monies that you would have paid will be refunded in full without the deduction of an administrative charge.
